Tiger Lilov’s Chess School provides its service to you subject to the following terms and conditions (the "Terms of Service"). Tiger Lilov’s Chess School may also offer other services that are governed separately by their own Terms of Service.
GENERAL
Welcome to Tiger Lilov’s Chess School! The following Terms of Service will provide you with specific information on the terms and conditions associated with ordering services from Tiger Lilov’s Chess School. The section Rewards and Penalties describes the different cases, in which one of the parties – the student or Tiger Lilov’s Chess School – will be given either rewards or penalties to compensate for lost opportunities and/or caused inconvenience for the other party as a result of an unexpected event, e.g. internet connection disruptions, unexpected absence from a lesson, tardiness with regard to the appointed date and time for a training session, and others. The term reward will be used to denote benefits the student is set to receive due to an unexpected event caused solely by Tiger Lilov’s Chess School. The term penalty will refer to the loss of parts of the service ordered due to an unexpected event caused solely by the student. Tiger Lilov’s Chess School is dedicated to serving its students with great care, which includes being flexible when interpreting the present terms of service.
TRAINING CREDIT BALANCE POLICIES
The term Training Credit Balance is the prepaid amount of service a student has ordered from www.TigerLilov.com. Since all the items offered by Tiger Lilov’s Chess School represent intangible services, students are required to submit their payments before they receive the service. In other words, each student is responsible for maintaining their Training Credit Balance positive at all times. A student with a positive Training Credit Balance will forfeit their credit for lessons, if they remain inactive for more than two months and do not make an attempt to contact FM Valeri Lilov to enquire about their training credit balance and/or request a new lesson to be scheduled. Any student who has been inactive for more than a month will be contacted directly by Tiger Lilov’s Chess School with an e-mail-reminder at least a week before their credit for lessons is set to be forfeited.
REWARDS AND PENALTIES
1.PRIVATE ONLINE LESSON CANCELLATIONS
An appointed Private Online Lesson with a student may be cancelled occasionally upon request by either the student or Tiger Lilov’s Chess School. The rules for cancelling an already booked Private Online Lesson apply to both parties and, if breached, Tiger Lilov’s Chess School is required to either give the appropriate reward or impose the necessary penalty to the student set to receive the cancelled Private Online Lesson on the given date. Please, note that in most cases a penalty refers to the loss of opportunity a student would suffer after missing or being late for a lesson.
RULES FOR PRIVATE ONLINE LESSON CANCELLATIONS
a. Either party should notify the other of any necessary lesson cancellation at least two full days before the date the actual lesson is set to be held. Of course, certain exceptions are permissible and the student will not automatically lose any privilege gained from the service they have ordered in advance.
b. If the student fails to comply with this rule, in most cases they will forfeit the opportunity to attend the live training session and will receive the recorded version of their lesson via e-mail. Once the student confirms they have received their recorded lecture associated with the missed lesson, the service will be considered provided and the credit for the lesson ordered will be subtracted from the students training credit balance.
c. If Tiger Lilov’s Chess School has to cancel a lesson, which is set for a date less than two days in the future, the school is obliged to provide the student with a legitimate excuse for the unexpected event, as well as offer them a reward equal in value to the type of lesson cancelled and also give the student the opportunity to reschedule their lesson for the earliest date available. The reward provided by the school can be anything from selected training materials related to the student’s personalized chess training program to personalized recorded lecture on a topic part of this program.
d. If the student is late for class, the time missed cannot be compensated after the scheduled end of the training session. Nevertheless, Tiger Lilov’s Chess School will make any effort to provide the student with all the information and planned training in the time left after the student showed up for their lesson.
2. HANDLING PERIOD FOR PRIVATE ONLINE LESSON RECORDINGS
Tiger Lilov’s Chess School uses the latest recording software to make recordings of its students’ lessons upon request. Nevertheless, occasionally, there may be a technical issue or a human error involved in the recording process, which may prevent a student from receiving their ordered lesson recording in its entirety. In very rare cases, the school may be unable to retrieve a damaged recording. A student who has ordered a Private Online Lesson Recording is guaranteed to receive their service timely.
RULES FOR HANDLING PRIVATE ONLINE LESSON RECORDINGS
a. For any student who ordered a Private Online Lesson Recording Service, Tiger Lilov’s Chess School is required to provide the student with the recording files within four days of the date the lesson recorded was held.
b. If Tiger Lilov’s Chess School fails to meet the deadline, the additional fee for the video or audio recording will be waived and paid back to the student at the school’s expense, while the student will still receive their Lesson Recording.
c. DISCLAIMER: If the recording files were sent via a download link or as an e-mail attachment, but cannot be accessed or opened by the student due to a technical issue and the deadline has passed in the meantime, the recording is considered delivered and technical issues are to be resolved with the assistance of the lecturer upon request on the student’s part.
d. In very rare cases, a Lesson Recording may fail during the actual lesson or the quality of the product may be unsatisfactory. In this case, Tiger Lilov’s Chess School is unable to submit the ordered recording to the student and will pay back the additional fee charged for that service after notifying the student timely.
3. HANDLING PERIOD FOR PERSONALIZED VIDEO LECTURES
Tiger Lilov’s Chess School uses the latest recording software to produce Personalized Video Lectures upon request. Recorded lectures require more time as much thought and preparation needs to be put into the lecture to ensure all relevant matters are raised and discussed, yet a student who has ordered a Personalized Video Lecture is guaranteed to receive their service timely.
RULES FOR HANDLING PERSONALIZED VIDEO LECTURES
a. For any student who ordered a Personalized Video Lecture to be prepared on a given topic or based on given games, Tiger Lilov’s Chess School is required to provide the student with the complete lecture video files within two weeks of receipt of the order or by the deadline agreed upon between the parties.
b. Though Tiger Lilov’s Chess School will strive to provide the student with the service as soon as reasonably possible, the deadline that a student may explicitly request for their video lecture to be completed cannot be set within one week of the date the order is made.
c. If the date proposed by the student is agreed upon by both parties, it becomes the final deadline for Tiger Lilov’s Chess School to provide the student with the service.
d. If the deadline for a video lecture has passed and the student has not yet received their service from Tiger Lilov’s Chess School, the school is required to pay back the student’s money charged for the service in full and, in most cases, provide the student with the service free of charge.
4. HANDLING PERIOD FOR PERSONALIZED TRAINING PACKAGE
Tiger Lilov’s Chess School uses the latest recording software to produce the lecture part of the Personalized Training Package. Recorded lectures, as well as training material selection both require more time as much thought and preparation needs to be put into the product to ensure all relevant matters are raised and discussed, yet a student who has ordered a Personalized Training Package is guaranteed to receive their service timely.
RULES FOR HANDLING PERSONALIZED TRAINING PACKAGES
a. For any student who ordered a Personalized Training Package to be prepared on a given topic, Tiger Lilov’s Chess School is required to provide the student with the complete lecture video files, training materials, and homework assignments within two weeks of receipt of the order or by the deadline agreed upon between the parties.
b. Though Tiger Lilov’s Chess School will strive to provide the student with the service as soon as reasonably possible, the deadline that a student may explicitly request for their training package to be completed cannot be set within four days of the date the order is made.
c. If the date proposed by the student is agreed upon by both parties, it becomes the final deadline for Tiger Lilov’s Chess School to provide the student with the service.
d. If the deadline for a training package has passed and the student has not yet received their service from Tiger Lilov’s Chess School, the school is required to pay back the student’s money charged for the service in full and, in most cases, provide the student with the service free of charge.
REGISTRATION
In consideration of your use of the Service, you represent that you are of legal age to form a binding contract. You also agree to provide true, accurate, current, and complete information about yourself as prompted by the Service's registration form and to maintain and promptly update the Registration Data to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, or if Tiger Lilov’s Chess School has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, Tiger Lilov’s Chess School has the right to suspend or terminate your account and refuse any and all current or future use of the Service. Tiger Lilov’s Chess School is concerned about the safety and privacy of all its students and will not share the information students submit on the registration form with third parties. Should the student to be registered is younger than 18 years old, their parent or legal guardian should complete the registration form for the student.
TRADEMARK INFORMATION
All Tiger Lilov’s Chess School trademarks and service marks and other Tiger Lilov’s Chess School logos and product and service names are trademarks of Tiger Lilov’s Chess School. If using the school trademark and/or logos on your website or elsewhere, you are required to properly refer them to their owner, Tiger Lilov’s Chess School.
INTELLECTUAL PROPERTY LIMIATIONS
Tiger Lilov’s Chess School has the exclusive right, title and interest to the contents of the Tiger Lilov’s Chess School site, TigerLilov.com, including without limitation, TigerLilov.com's trademark, service marks, copyrights and other intellectual property (the "Proprietary Rights"), unless otherwise specified therein. Except as provided herein, you acknowledge that you are not granted by implication, estoppels, or other means any license or right to use the Tiger Lilov’s Chess School site. All rights not expressly granted herein are reserved by Tiger Lilov’s Chess School. All contents of the Tiger Lilov’s Chess School site are: Copyright 2009-2010 Valeri Lilov. All Rights Reserved.
OTHER
This Terms of Service Agreement constitutes the entire agreement between Tiger Lilov’s Chess School and you with respect to the subject matter contained herein and supersedes all previous and contemporaneous agreements, proposals and communications, written or oral.
Tiger Lilov’s Chess School may amend or modify this Terms of Service Agreement or impose new conditions at any time. Such amendments and modifications shall be effective immediately upon notice thereof which may be given by means including, but not limited to, posting on the Tiger Lilov’s Chess School’s website, http://www.tigerlilov.com/. Any use of the Service by you after such notice shall be deemed to constitute acceptance by you of such amendments, modifications, or new conditions. This agreement shall be governed by and construed in accordance with the laws of Bulgaria without giving effect to any principles or conflicts of law. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
